Qualifying data access before selling offshore services to UK buyers
Map data, access locations and subcontractors early so UK buyers can evaluate an offshore service before commercial commitments become difficult to change.

Make the delivery model visible early
A UK prospect may like an offshore service proposal but need to understand who will access information, from where and for what purpose. These questions should influence qualification before the final contract stage. A low-friction sales presentation can become a difficult procurement discussion if the delivery model was left vague.
The Information Commissioner's Office's controller–processor contract guidance addresses processing details, security, subprocessors, assistance and end-of-contract arrangements. This is concrete evidence that a buyer may need a structured description of the service, not merely a confidentiality assurance.
Map access as well as storage
Document the information involved, the systems used, the people who need access and their locations. Include subcontractors and support arrangements. Do not assume that keeping a database on a UK-hosted platform answers every question about an overseas team's access.
ICO's international-transfer guidance explains that determining whether transfer rules apply requires analysis of the actual circumstances. Sales should gather accurate facts for that review rather than declare the arrangement compliant. The guidance also notes that transfer analysis is only one part of wider data-protection responsibilities.
Offer a staged evaluation without overstating compliance
Where useful and accepted by the buyer, begin with synthetic or appropriately approved demonstration information. Separate a workflow demonstration from live service delivery. A successful demo does not establish permission for a production team to process personal information.
Ask the buyer's privacy, security and procurement owners what they need to evaluate the proposed arrangement. Obtain qualified advice on contractual and international-transfer questions. ICO guidance can change, and the contract guidance inspected notes that it is under review; verify current material before relying on it.
Complete an illustrative delivery-data worksheet
Imagine a fictional Pakistan-based support provider proposing work for a UK software company. The provider maps ticket fields, support tools, staff locations and an external quality reviewer before promising a launch date. The buyer can then assess the real service model.
This suggested worksheet is not legal advice or a claim of regulatory approval. Its purpose is to prevent commercial commitments from outrunning factual discovery. Advance the opportunity when the relevant reviewers understand the scope and identify a workable approval route.
- Information: list necessary data categories and unnecessary fields to exclude.
- Access: identify staff, locations, permissions and systems.
- Subcontractors: disclose each proposed participant and its function.
- Lifecycle: describe retention, return, deletion and access removal.
- Review: assign buyer and supplier owners for specialist assessment.
